Atty. Teodoro A. Pastrana clarified that the Senate cannot lack members during an impeachment vote against Vice President Sara Duterte, as the Constitution requires 16 votes out of 24 senators.
He explained that Republic Act 6645 mandates special elections by the Commission on Elections to fill vacancies caused by death or incapacity.
Pastrana assured that the law itself provides solutions to guarantee the Senate’s capacity to proceed with the impeachment process.
