National Union of Peoples’ Lawyers (NUPL) President Atty. Ephraim Cortez stated that the Senate holds exclusive authority to establish its internal rules and determine voting threshold calculations during an impeachment trial.
Cortez explained that while the Constitution mandates a two-thirds vote, it does not explicitly define denominator calculations when senator-judges are absent or legally unable to participate.
Consequently, the Senate Impeachment Court possesses the discretion to interpret and set voting rules.
