Attorney Oscar Moreno, former mayor of Cagayan de Oro and law professor at Xavier University, said the impeachment trial against Vice President Sara Duterte could be stopped if her camp petitions the Supreme Court to question Senate decisions—such as the debated number of votes required for conviction.
Moreno clarified that the Senate does not have ultimate authority to interpret the Constitution, so the Supreme Court could issue a temporary restraining order if it finds legal issues in the process.
He warned that such a move could paralyze the trial and delay proceedings until 2027, coinciding with the election period.
Filing a petition with the Supreme Court, he added, is among the legal strategies the defense may pursue to challenge the impeachment court’s ruling.
